By accessing or using our Services, you affirm that you are at least 18 years of age or have the consent of a parent or guardian. If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind such organization to these Terms.

2. Services Offered

MuseWhirl offers guided tours of various art museums, galleries, and exhibitions. Our tours may include audio guides, written materials, and interactive experiences. We reserve the right to modify or discontinue any aspect of our Services at any time without notice.

3. Registration and User Accounts

To use some features of our Services, you may need to register for a MuseWhirl account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and take full responsibility for your account.
  • Notify us immediately of any unauthorized use of your account.
  • Be responsible for all activities that occur under your account.

4. Payment Terms

All fees for the Services offered by MuseWhirl must be paid in full at the time of booking. We accept various forms of payment, which may change from time to time. By providing your payment information, you agree to pay all fees associated with your booking.

Refunds are subject to our cancellation policy, as outlined in Section 8 of these Terms.

5. Pricing and Availability

Prices are subject to change without notice. MuseWhirl does not guarantee the availability of any tour and reserves the right to limit the number of participants in any tour. Prices displayed on our website at the time of booking are the final prices you will pay.

6. Code of Conduct

You agree to conduct yourself in a respectful manner while participating in any tour organized by MuseWhirl. This includes:

  • Being courteous to our staff and other participants.
  • Following the instructions provided by your tour guide.
  • Not engaging in any behavior that disrupts the experience for others.

MuseWhirl reserves the right to refuse service to anyone who fails to comply with this Code of Conduct.

7. Intellectual Property

All content associated with MuseWhirl, including text, graphics, logos, and images, is the property of MuseWhirl or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use any of our intellectual property without our express written consent.

8. Cancellation and Refund Policy

Should you need to cancel your booking, please notify us as soon as possible. Our cancellation policy is as follows:

  • Cancellations made more than 48 hours before the start time of the tour will receive a full refund.
  • Cancellations made between 24 and 48 hours before the start time of the tour will receive a 50% refund.
  • No refunds will be issued for cancellations made less than 24 hours before the tour.

9. Liability

MuseWhirl is not liable for any indirect, incidental, or consequential damages arising from your use of the Services, or for any loss or damage of any kind arising from your travel to or from the tour location.

We are also not responsible for loss or damage to personal property during the tour, and we strongly advise participants to take care of their belongings.

10. Modifications to Terms

MuseWhirl reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the Services following any changes constitutes your acceptance of the new Terms. We recommend that you periodically review these Terms for any updates.

11. Governing Law

These Terms shall be governed by, and construed in accordance with, the laws applicable in the jurisdiction where MuseWhirl operates, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in that jurisdiction for the resolution of any disputes.

12. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect. The unlawful, void, or unenforceable provision shall be deemed modified to the extent necessary to make it lawful, valid, and enforceable.

13. Waiver

The failure of MuseWhirl to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of MuseWhirl.

14. Entire Agreement

These Terms constitute the entire agreement between you and MuseWhirl regarding your use of the Services and supersede all prior agreements and understandings, whether written or oral, relating to the Services.
